Please read these Terms & Conditions (“Terms”) carefully before using the website or services of Upright Air Solutions LLC (“Company,” “we,” “our,” or “us”). By using our website, requesting a quote, or engaging our services, you agree to be bound by these Terms.

1. Eligibility

Our website and services are intended for use by adults aged 18 or older. By requesting service, submitting a form, or agreeing to these Terms, you represent that you are at least 18 years old and have the legal authority to request HVAC service at the property in question. If you are requesting service on behalf of a minor’s residence, you confirm that you are the parent, legal guardian, property owner, or other adult with authority to do so.

2. Description of Services

Upright Air Solutions LLC provides residential and commercial HVAC services, including but not limited to air conditioning repair, heating and furnace repair, heat pump repair, HVAC system repair, and related diagnostic and maintenance services, within our service area of approximately 35 miles of Wellford, South Carolina.

Service availability, scheduling, and pricing are subject to change and are confirmed at the time of booking or on-site visit.

3. Quotes, Estimates & Pricing

Quotes and estimates provided by phone, online form, or in writing prior to an on-site visit are preliminary and based on the information you provide. Final pricing is confirmed after an in-person diagnostic assessment, as the actual scope of work may differ once a technician has inspected the system.

A diagnostic or service call fee may apply and will be disclosed to you before any work begins. If you choose to proceed with a recommended repair, any diagnostic fee already collected will be handled according to the terms provided to you at the time of service.

4. Scheduling, Cancellations & Rescheduling

Appointments may be scheduled through our website, by phone, or by text message where you have provided consent to receive text messages. We will make reasonable efforts to arrive within the scheduled window, but arrival times may be affected by prior jobs, traffic, weather, or emergency service calls.

If you need to cancel or reschedule an appointment, please notify us as soon as possible by phone or by replying to any confirmation text or email you have received. Repeated late cancellations or missed appointments may affect our ability to offer future scheduling priority.

5. Assumption of Risk & Limitation of Liability

HVAC systems involve electrical components, refrigerants, combustible fuel sources, and mechanical equipment that carry inherent risks. By engaging our services, you acknowledge these risks and agree that:

• Upright Air Solutions LLC will perform services using reasonable care and in accordance with applicable codes and manufacturer specifications.
• We are not responsible for pre-existing conditions, damage, or system failures not caused by our work, including issues arising from the age, condition, or improper prior installation or repair of your HVAC system, ductwork, or electrical systems.
• Our liability for any claim arising from our services is limited to the cost of the service performed, except where such limitation is not permitted by South Carolina law.
• We carry general liability insurance and are a licensed HVAC contractor in the State of South Carolina (SC Mechanical License #118415).
• Workmanship on repairs we perform is warrantied for a reasonable period following service, and manufacturer warranties apply to parts as provided by the manufacturer. Specific warranty terms for your service will be provided on your invoice or service agreement.

6. Payment Terms

Payment is due upon completion of service unless other arrangements have been agreed to in writing in advance. We accept the payment methods disclosed to you at the time of booking or invoicing.

Financing may be available for qualifying work; financing terms are governed by the financing provider’s own agreement, not by these Terms.

7. SMS Terms

By providing your mobile phone number and checking the applicable consent checkbox on our website, you agree to receive text messages from Upright Air Solutions LLC as described below.

Types of messages. Depending on the consent you provide, you may receive service and transactional messages (appointment scheduling, confirmations, technician updates, service reminders, and follow-up) and/or promotional and marketing messages (seasonal reminders, offers, and specials). These consents are collected separately, and you may agree to one, both, or neither.

Message frequency. Message frequency varies depending on your service activity and the type of messages you have agreed to receive.

Cost. Message and data rates may apply, according to the terms of your plan with your mobile carrier.

Carrier liability. Mobile carriers are not liable for delayed or undelivered messages. Upright Air Solutions LLC is not responsible for any delays or failures in SMS message delivery caused by your mobile carrier or network conditions.

Consent is not a condition of purchase. Consenting to receive text messages is not required as a condition of requesting service, obtaining a quote, or purchasing any service from us.

Privacy. Your use of our SMS program is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information, including your mobile phone number.

8. Website Use & Intellectual Property

The content on this website, including text, images, and logos, is the property of Upright Air Solutions LLC unless otherwise noted, and may not be copied or used without our permission.

You agree not to use this website in any way that could damage, disable, or impair its functioning, or to attempt to gain unauthorized access to any part of the site.

9. Third-Party Links

Our website may link to third-party websites, including payment processors and social media platforms. We are not responsible for the content, accuracy, or practices of any third-party site.

10. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of law principles. Any disputes arising from these Terms or our services shall be resolved in the state or federal courts located in South Carolina.
